Terms & Conditions
Welcome to the Lemuel MC website a home for sustainable artisan clothing. The website is operated from our office at 49 Tyeshurst Close, SE2 0DZ, London, England. This website is wholly owned by Lemuel MC. Use of this website is governed by the terms and conditions set out below. ‘Customer’ is the person referred to as the buyer who is purchasing the goods.
1.1. Both UK and International prices are quoted in British pounds .
2.1. Online payment using PAYPAL or DEBIT OR CREDIT methods of payment.
3. Retention of Title
Title of the invoiced goods will only pass to the customer once full payment of the invoice is received.
4.1. UK - recorded delivery: Monday to Friday only. Please allow 3-5 working days for delivery after your garment is made. Lemuel MC will acknowledge on receipt of order if there is any change to the delivery period.
4.2. Overseas - recorded delivery: conditions as above except please allow 7-10 working days for delivery.
4.3. Product unavailability will be acknowledged as soon as possible and money refunded.
4.4. Lemuel MC is not responsible for any lost order by a third party once the goods have left Lemuel MC registered premises. If the received goods are damaged, a refund or exchange will be accepted only if the goods are returned within 14 working days from the signed receipt of the goods, with the original packaging to our registered office.
4.5. Packaging - every item is gift wrapped and packed using recycled wallpaper.
5. Returned goods and cancelled orders
5.1. Lemuel MC will only accept returned goods if the customer complies with clause 5.
5.2. If the goods are defective or ordered incorrectly, the customer will receive a full refund, credit note or exchange. The goods must be returned to us before a full refund, credit note or exchange can be issued.
5.3. Lemuel MC cannot be held responsible for goods sent by a customer which are lost in transit.
5.4. If an order is cancelled after it has been dispatched, the return procedure outlined in clause 6 will apply. If the procedure is not adhered to, the order will be deemed valid and the customer liable for full payment.
5.5. All returned goods must be returned in the original packaging to ensure goods are not damaged in transit.
5.6 We are very sorry but we can’t accept returns for bespoke (i.e. customised, personalised, altered) items. If you are not fully satisfied with your bespoke item, we will try to alter it, as far as is possible, to your preference, if you contact us within 14 days of receipt. We will do our best but we can’t re-sell bespoke items so refunds would not be available.
6. Product acceptance
The customer shall inspect the goods and notify Lemuel MC within 14 working days from receipt of goods if there is a reason for rejection. If notification is not received within 14 working days, Lemuel MC will assume the goods are satisfactory and any rejection will not be acceptable beyond this period. This does not affect the customer’s statutory rights.
7. FREE lifetime repairs
Our clothes are designed and made to last but they’re not indestructible.
If they’re looked after there is no reason why they shouldn’t stay beautiful, and even softer, for years and years.
Clothes and accessories are meant to be worn, of course, and normal wear-and-tear does happen.
With this in mind, and as part of our commitment to sustainability, we will repair damage caused by normal wear-and-tear for FREE – all you pay is postage to us and back.
- Loose seams.
- Loose hems.
- Loose poppers.
- Broken poppers i.e. they don’t fix.
- Unstitched pockets.
- Damage beyond everyday wear-and-tear e.g. stains, cuts, burns.
- Damage caused by not following washing instructions.
- Most rips of the fabric itself (not the seams) – linen is tough so we’d be surprised to hear if it ripped, but please get in touch to ask if this happens.
This is not an exhaustive list and repairs will be at our discretion, but our preference is to help if possible!
If you would like to claim your repair, please get in touch with us by email to firstname.lastname@example.org with details of the damage. Photos will help if possible. Your email receipt will also be useful so we can trace the purchase.
We’d like to help if we can, but if we think the damage is not covered by this policy we’ll explain why within 72 hours.
If it is suitable for free repair, please send the item to us by tracked delivery. Please pack it in a way that will protect it from further damage.
Please give us two weeks from receipt to repair the item. We do not envisage it ever taking this long, but it will not take longer.
We will send back the repaired item to you by tracked delivery(you will have to cover delivery charge).
7.2 Extra conditions:
The policy only applies for items bought directly from this website. For items purchased from stockists, please check with the stockist in question. We have agreed repairs with some but not all, so please double-check with them before sending anything to us!
This policy applies for all items bought from this website from 1 January 2019 (but please get in touch if you bought an earlier item – We want to be reasonable but thought we should pick a start date!)
We are not responsible for any items lost in the post. Please send your items tracked and signed.
8. Force Majeure
Lemuel MC shall not be liable to the customer for any loss or damage which may be suffered by the customer as a direct or indirect result of the supply of Goods by Lemuel MC being prevented, hindered, delayed or rendered uneconomic by any cause whatsoever beyond Lemuel MC's control and in particular but without prejudice to the generality of the foregoing by Act of God, war, riot, civil commotion, Government controls restrictions or prohibitions or any other Government act or omission whether local or national, fire, flood, subsidence, sabotage, accident, breakdown of plant or machinery, strike or lock out, trade dispute or labour disturbance or difficulty or increased expense in obtaining labour, materials, or transport or other circumstances affecting the supply of Goods or raw materials by Lemuel MC’s normal source of supply or the delivery of Goods by Lemuel MC’s normal route or means of delivery.
9. Severance and Waiver
9.1. In the event of any part of these conditions being ineffective for any reason, the remainder thereof shall constitute the conditions binding upon the parties.
9.2. Failure or neglect by Lemuel MC to enforce at any time any of the provisions hereof shall not be construed as, nor be deemed to be, a waiver of Lemuel MC's rights hereunder, nor shall such failure or neglect in any way affect the validity of the whole or any part of these terms and conditions and Lemuel MC's right to take subsequent action shall not be prejudiced thereby.
10.1. All data received is processed and managed in accordance with the Data Protection Act 1998. Lemuel MC retains this information on a secure server. Credit card details are not retained.
10.2. Lemuel MC will never request credit card details by email.
11. Legal notice
11.1. Lemuel MC reserves the right to amend, delete and alter any terms and conditions without notice. Updated conditions of sale will be immediately published once these changes have been made.
11.2. Lemuel MC reserves the absolute right to amend, modify or withdraw, temporarily or permanently the Lemuel MC website without notice.
11.3. All rights including copyright in this website are owned or licensed by Lemuel MC. Modification, distribution and reposting any material on this website are strictly prohibited.
12. Marketing literature
Only by signing to a newsletter will marketing literature will be sent to the customer. This will be sent via email advising you of events, new products, special offers or promotions.
13.1. Lemuel MC makes every reasonable effort to ensure that the information provided, namely goods description, colour of goods and general marketing materials, is accurate. Lemuel MC does not provide warranties to its accuracy or completeness. Moreover, Lemuel MC will not be responsible for any errors or omissions arising from such information.
13.2. Lemuel MC shall not be liable to any person or persons for any loss or damage arising from the use of the information provided on the Lemuel MC website.
13.3. Lemuel MC shall not be liable to any person or persons for loss or damage arising owing to the failure of the customer not protecting their password or account details. All personal data must be accurate and complete including invoice, delivery addresses and postcodes. Any changes must be notified to Lemuel MC immediately.
13.4. Lemuel MC makes all reasonable endeavours to secure the reliable accurate flow of information whilst using the Lemuel MC website. However, Lemuel MC cannot be liable for any misinterpretation, error, disruption, corruption or loss of material when information is downloaded within a computer system.
13.5. Lemuel MC uses its best endeavours to ensure its website has no defects or viruses. Thus Lemuel MC cannot be held responsible for any damage or error arising on the customer’s computer when accessing Lemuel MC’s website.
13.6. The complete and entire liability of Lemuel MC shall not exceed the value of the goods ordered, except as advised in these conditions.
14. Legal Interpretation
Any agreement to which these terms and conditions apply shall be governed and construed in accordance with English Law and any dispute arising out of or in connection with such agreement shall be determined by the English Courts.
